1. Agreement to Terms
By accessing or using PensionForge (the "Service"), available at https://pensionforge.com, you agree to be bound by these Terms of Service ("Terms"). If you do not agree to all of these Terms, you may not access or use the Service.
These Terms constitute a legally binding agreement between you ("User," "you," or "your") and PensionForge, LLC ("Company," "we," "us," or "our"). We reserve the right to modify these Terms at any time. Material changes will be communicated via email to registered users or by prominent notice on the Service at least thirty (30) days prior to taking effect. Your continued use of the Service after such notice constitutes acceptance of the modified Terms.
2. Description of Service
PensionForge is a web-based retirement scenario modeling tool designed for members of the Florida Retirement System ("FRS"), including Special Risk Class members (firefighters, law enforcement officers, corrections officers, and EMS personnel) and Regular Class members (teachers, state employees, and local government employees).
PensionForge is not affiliated with, endorsed by, or connected to the Florida Retirement System, the State Board of Administration of Florida, the Florida Division of Retirement, or any other Florida state or local government agency. Any references to official FRS rules, Florida statutes, or government resources are for educational context only and do not imply endorsement or affiliation.
The Service provides the following features:
- Retirement calculators: Pension projection, Average Final Compensation (AFC), Deferred Retirement Option Plan (DROP), DROP decision comparison, contributions, contribution mix, plan election, relocation impact, and projection scenarios.
- Scenario modeling: The ability to create, save, compare, and revisit personalized retirement scenarios.
- PDF reports: Server-rendered downloadable reports including individual scenario summaries, scenario comparisons, portfolio overviews, household summaries, and dashboard summaries.
- AI-generated narrative summaries: On-demand natural language summaries of your scenario projections, generated via third-party AI (Anthropic Claude) and displayed on the dashboard.
- Threshold alerts: Email-based notifications when user-defined financial metrics cross specified thresholds.
- Household modeling: Spouse income and multi-account retirement planning (Pro tier).
- Educational content: Articles and resources explaining FRS rules, benefits, and legislative developments.
- Offline functionality: Core calculator operations and authenticated profile/scenario data are cached locally for use without an internet connection.
3. Educational Purpose Only -- No Financial Advice
3.1 Not a Financial Advisor
PensionForge is for educational and informational purposes only. The Service does not provide financial, tax, legal, or investment advice. PensionForge is not a registered investment advisor, broker-dealer, financial planner, tax preparer, or legal professional.
3.2 No Affiliation with Government Entities
PensionForge is not affiliated with, endorsed by, or connected to the Florida Retirement System, the State Board of Administration of Florida, the Florida Division of Retirement, or any other Florida state or local government agency. Any data sourced from official FRS publications, Florida statutes, or IRS notices is reproduced for educational purposes and does not constitute an official government communication.
3.3 Projections Are Estimates
All projections, calculations, and outputs generated by the Service are estimates based on:
- The inputs you provide;
- Current FRS rules and formulas as publicly available at the time of calculation;
- Assumptions and models that may not reflect future conditions.
Investment Plan projections rely on assumed rates of return and market conditions that are inherently uncertain and may differ materially from actual results. Pension Plan (defined-benefit) projections, by contrast, are based on statutory formulas but remain subject to legislative change. These projections do not guarantee any specific retirement benefit, account balance, or financial outcome. FRS rules, benefit formulas, contribution rates, and related policies are subject to change by the Florida Legislature at any time.
3.4 Tax Information Limitations
Any tax bracket information or tax-related calculations displayed by the Service are shown for contextual purposes only. They do not represent complete tax calculations and do not account for deductions, credits, filing status nuances, or other adjustments that may affect your actual tax liability.
3.5 Health Insurance Subsidy (HIS) Disclaimer
The FRS Health Insurance Subsidy is funded by a separate employer contribution and is subject to annual legislative appropriation. It is not a guaranteed benefit and may be modified or discontinued by the Florida Legislature.
3.6 Obligation to Seek Professional Advice
You are solely responsible for your own financial decisions. We strongly encourage you to consult a qualified, licensed financial advisor, tax professional, or attorney before making any decisions regarding your retirement, investments, or financial planning.
4. User Accounts
4.1 Account Creation
To access certain features of the Service (including saving scenarios, setting alerts, and generating reports), you must create an account by providing a valid email address. You may authenticate via email magic link or Google OAuth.
4.2 Account Eligibility
You must be at least eighteen (18) years of age to create an account and use the Service. By creating an account, you represent that you meet this requirement.
4.3 Account Security
You are responsible for maintaining the security of your account credentials and any devices used to access the Service. You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss or damage arising from unauthorized access to your account.
4.4 Account Accuracy
You agree to provide accurate, current, and complete information during registration and while using the Service. You are responsible for keeping your account information up to date.
4.5 Consent Regarding Third-Party Data
The Service includes household modeling features that allow you to enter financial information about a spouse or other household member. By entering another person's information, you represent that you have that person's consent to provide their data to the Service for retirement modeling purposes. You may not enter the personal information of any minor (under 18) except where required for dependent-related calculations and where you are the minor's parent or legal guardian.
4.6 Account Termination
You may delete your account at any time. We reserve the right to suspend or terminate your account if:
- You violate these Terms;
- You provide false or misleading information;
- Your use of the Service poses a security risk or may cause harm to us or other users;
- Required by law.
Upon termination, your right to use the Service ceases immediately. We may retain certain data as described in Section 8.6.
5. Subscription Plans and Payments
5.1 Free Tier
PensionForge offers a free tier that includes access to all nine calculators, educational content, and offline functionality. No payment information is required for the free tier. PDF reports generated on the free tier include a PensionForge watermark.
5.2 Paid Plans
The Service offers a paid subscription plan ("Pro" tier) that provides additional features including household modeling, unlimited scenarios, scenario comparison tools, portfolio and household PDF reports, and unlimited threshold alerts. "Founder" is a special promotional enrollment status within the Pro tier—Founder subscribers receive the same features as Pro but at a locked-in introductory rate as described in Section 5.7. 5.3 Payment Processing
All payments are processed by Stripe, Inc. ("Stripe"), a PCI-compliant third-party payment processor. PensionForge does not store your credit card number, CVV, or other sensitive payment credentials. By subscribing to a paid plan, you also agree to Stripe's terms of service and privacy policy.
5.4 Recurring Billing and Automatic Renewal
By subscribing to a paid plan, you authorize PensionForge to charge your selected payment method on a recurring basis.
- Billing intervals: Paid subscriptions are billed either monthly or annually, depending on the plan you select at checkout.
- Charge amount: You will be charged the subscription price displayed at the time of your initial purchase (or, for renewals, the then-current price subject to Section 5.7).
- Renewal timing: Your subscription will automatically renew at the end of each billing cycle (monthly anniversary or annual anniversary of your subscription start date) unless you cancel before the renewal date.
- Renewal charge: Each renewal charge will be billed to the same payment method on file at the start of the new billing cycle.
- Express consent: By completing checkout, you expressly consent to the recurring charges described above and acknowledge that your subscription has an automatic renewal feature.
5.5 Cancellation
You may cancel your subscription at any time through the Stripe customer billing portal accessible from your account settings (Profile > Manage Subscription). Cancellation takes effect as follows:
- Your paid features remain accessible until the end of the current paid billing period;
- No further charges will be billed after cancellation;
- Your account reverts to the free tier at the end of the paid period;
- No partial or prorated refunds are provided for the unused remainder of a billing cycle in which you cancel.
5.6 Refund Policy
You are entitled to a full refund if you cancel within fourteen (14) days of your initial subscription purchase, provided you have not generated more than three (3) PDF reports during that period. After the 14-day window, or for renewal charges, refunds are at our sole discretion and will be evaluated on a case-by-case basis. To request a refund, contact team@pensionforge.com or use the billing portal.
5.7 Price Changes
We reserve the right to change subscription pricing. Existing subscribers will receive at least thirty (30) days' advance notice of any price increase via email. Price increases will take effect at the beginning of your next billing cycle following the notice period. If you do not agree to the new price, you may cancel before the next renewal and will not be charged the increased rate. Founder Plan subscribers who maintain continuous, uninterrupted enrollment retain their locked-in rate.
5.8 State Automatic-Renewal Compliance
Certain states (including California, New York, Virginia, Colorado, and others) impose specific requirements on automatic-renewal and continuous-service offers, such as clear disclosure, affirmative consent, easy cancellation, and renewal reminders. To the extent required by applicable state law:
- We will send you a renewal reminder email at least three (3) days (or such longer period as required by your state) before each annual renewal charge;
- Monthly subscriptions renew without individual reminders, consistent with your express consent at checkout;
- You may cancel at any time using the self-service method described in Section 5.5 without penalty or obligation beyond the current billing period;
- If required by your state, we will provide a toll-free telephone number or other additional cancellation mechanism upon request.
6. Acceptable Use
6.1 Permitted Use
You may use the Service for your personal, non-commercial retirement planning and education purposes in accordance with these Terms.
6.2 Prohibited Conduct
You agree not to:
- Use the Service to provide financial advisory services to third parties or hold yourself out as a financial advisor based on outputs from the Service;
- Reproduce, redistribute, sell, sublicense, or otherwise commercially exploit any outputs, reports, or content generated by the Service without our prior written consent;
- Attempt to reverse engineer, decompile, or extract source code from the Service;
- Circumvent, disable, or otherwise interfere with security features, rate limiting, access controls, or authentication mechanisms;
- Use automated means (bots, scrapers, crawlers) to access the Service without prior written permission;
- Introduce malicious code, viruses, or other harmful material;
- Impersonate another person or entity, or misrepresent your affiliation with any person or entity;
- Use the Service in violation of any applicable local, state, national, or international law or regulation;
- Interfere with or disrupt the integrity or performance of the Service or its underlying infrastructure;
- Attempt to gain unauthorized access to other users' accounts or data;
- Use the Service to generate misleading or deceptive content about FRS benefits for purposes of fraud or misrepresentation.
6.3 Rate Limiting
The Service implements rate limiting on certain features (including account creation, feedback submission, waitlist signups, and AI-generated narrative summaries) to maintain service quality and prevent abuse. AI features are subject to daily usage caps. Circumventing rate limits is a violation of these Terms.
7. Intellectual Property
7.1 Ownership
All content, design, code, trademarks, logos, and other intellectual property comprising the Service (excluding User Content as defined below) are and remain the exclusive property of PensionForge, LLC or its licensors. These Terms do not grant you any right, title, or interest in our intellectual property except as explicitly stated herein.
7.2 Limited License to Users
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial purposes.
7.3 User Content
"User Content" refers to any data, inputs, or information you provide to the Service (including scenario parameters, profile information, and alert configurations). You retain ownership of your User Content. By using the Service, you grant us a limited license to process, store, and display your User Content solely for the purpose of providing the Service to you.
7.4 Generated Reports
PDF reports and other outputs generated by the Service using your inputs are provided for your personal use. You may share reports with your financial advisor, spouse, or other personal advisors. You may not commercially distribute, sell, or publish reports generated by the Service.
7.5 Feedback
If you voluntarily submit feedback, suggestions, or ideas regarding the Service, you grant us a perpetual, irrevocable, royalty-free license to use such feedback for any purpose without obligation to you.
8. Data and Privacy
8.1 Data Collection
We collect and process the following categories of information:
- Account information: Email address, authentication method, and account creation date;
- Profile information: Career stage, job classification, FRS class designation, hire date, date of birth, and other retirement-relevant data you provide;
- Scenario data: Inputs you provide for retirement calculations and the corresponding calculated results;
- Household data: Spouse or household member income and retirement information you provide (Pro tier);
- Alert configurations: Threshold metrics, directions, and values you define;
- Waitlist data: Email address, tier interest (Pro or Founder), source page, and your user ID if you are signed in at the time of signup;
- AI narrative data: Cached narrative text and generation counters associated with your scenarios;
- Usage analytics: Pages visited and features used, collected via Vercel Analytics;
- Performance metrics: Page load times and Core Web Vitals data, collected via Vercel Speed Insights;
- Payment data: Subscription status and Stripe customer identifiers (payment card details are processed and stored exclusively by Stripe).
8.2 Data Use
Your data is used solely to:
- Provide, maintain, and improve the Service;
- Process your retirement calculations and generate projections;
- Generate AI narrative summaries of your scenario projections (when you request them);
- Deliver threshold alert notifications;
- Process subscription payments;
- Send waitlist confirmation and notification emails;
- Communicate with you regarding your account and the Service;
- Enforce rate limits and detect abuse (using IP address).
8.3 Data Protection
- All user data stored on our servers resides in a PostgreSQL database with per-user Row-Level Security (RLS) policies that enforce data isolation between users;
- Saved scenarios and profiles are tied exclusively to your authenticated account;
- We encrypt data in transit using TLS/SSL.
8.4 Offline and Local Data Storage
- Unauthenticated use: Calculator inputs and results remain entirely in your browser's memory and are not transmitted to our servers;
- Authenticated offline storage: When you are signed in, the Service caches your profile data (including date of birth and hire date) and scenario data locally in your browser's IndexedDB storage to enable offline access. This data remains on your device and is not protected by server-side access controls (such as Row-Level Security); it is accessible to anyone with physical or software access to your browser's storage. Data is encrypted in transit when synced with our servers. You may clear locally cached data at any time by clearing your browser's site data for pensionforge.com.
8.5 Data We Do Not Collect or Use
- We do not sell your personal data or scenario inputs;
- We do not use your data to market financial products;
- We do not serve advertisements;
- We do not share your data with financial product providers;
- Date of birth is used solely for age and retirement timeline calculations and is not retained in scenario result records.
8.6 Third-Party Data Processors
The Service uses the following third-party processors:
- Supabase (database hosting and authentication);
- Stripe (payment processing and subscription billing);
- Vercel (application hosting, Vercel Analytics, and Vercel Speed Insights);
- Resend (transactional email delivery for alerts, waitlist confirmations, and notifications);
- Anthropic (AI narrative generation from scenario projection data; see Section 9.3);
- Google (OAuth authentication, if selected by the user).
Each third-party processor operates under its own privacy policy and data processing terms.
8.7 Data Retention and Deletion
User data is retained for the duration of your active account. Upon account deletion:
- Your profile, saved scenarios, alert configurations, AI narrative caches, and associated data will be permanently deleted from our active databases;
- Stripe retains payment transaction records, invoices, and subscription history as required by financial regulations and Stripe's own data retention policies;
- Resend retains transactional email metadata (delivery status, timestamps) for up to 30 days; email content is not retained by PensionForge beyond transmission;
- Vercel retains analytics and performance data per Vercel's own data retention policies. Vercel Web Analytics data is anonymous by design and does not collect personal identifiers. All data is encrypted at rest (AES-256) and in transit (TLS);
- Server logs containing IP addresses are retained for up to 3 days (application hosting) and 7 days (database infrastructure) for security and abuse prevention, then automatically purged;
- Encrypted backups of our database are taken daily and retained for up to 7 days. Backups are encrypted at rest (AES-256);
- We may retain specific records as required for tax and accounting compliance (e.g., payment records for up to seven years as required by IRS regulations);
- We may retain information necessary to investigate fraud or security incidents, enforce these Terms, or comply with legal obligations (subpoenas, court orders, regulatory inquiries);
- Waitlist records are retained until you unsubscribe or request deletion.
We may retain anonymized, aggregated data that cannot identify you indefinitely for analytical purposes.
8.8 Privacy Policy
These Terms are supplemented by our Privacy Policy, which provides additional detail regarding data collection, use, disclosure, and your rights. In the event of a conflict between these Terms and the Privacy Policy regarding data practices, the Privacy Policy shall control.
9. Third-Party Services
9.1 Third-Party Integration
The Service integrates with third-party services as described in Section 8.6. Your use of these third-party services may be subject to their respective terms and conditions.
9.2 Third-Party Links
The Service may contain links to third-party websites (including FRS official resources, legislative references, and educational materials). We do not control, endorse, or assume responsibility for the content, accuracy, or practices of any third-party website. The inclusion of any link does not imply affiliation with or endorsement by the linked organization.
9.3 AI-Generated Content
The Service uses Anthropic's Claude API to generate natural language narrative summaries of your scenario projections. When you request a narrative summary:
- Scenario-derived projection context (numerical results and calculation parameters) is sent to Anthropic for processing;
- Generated narratives are cached on our servers and associated with your account;
- Generation frequency is tracked per user by date (user ID and generation date);
- We do not send your name, email address, scenario names, or other personally identifiable account information to Anthropic.
AI-generated content is provided for informational and explanatory purposes only. It is subject to the same educational-purpose-only limitations described in Section 3 and is not financial advice. AI-generated content may occasionally contain errors, inaccuracies, or outdated information.
10. Disclaimers of Warranties
10.1 "As Is" Provision
THE SERVICE IS PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT.
10.2 No Warranty of Accuracy
WE DO NOT WARRANT THAT:
- Projections or calculations will be accurate, complete, or current;
- The Service will reflect the most recent changes to FRS rules, Florida statutes, IRS regulations, or other applicable law;
- The Service will be uninterrupted, timely, secure, or error-free;
- Any errors in the Service will be corrected.
10.3 Legislative and Regulatory Changes
FRS benefit rules, contribution rates, retirement eligibility criteria, tax laws, and related regulations are subject to change at any time by the Florida Legislature, the U.S. Congress, or applicable regulatory bodies. While we endeavor to update the Service promptly, we make no guarantee that the Service reflects the most current rules at any given time.
10.4 Calculation Model Limitations
Retirement projections involve assumptions about future events (including investment returns, inflation rates, legislative stability, and personal circumstances) that are inherently uncertain. No mathematical model can predict the future with certainty. The Service's outputs are estimates, not guarantees.
11. Limitation of Liability
11.1 Exclusion of Damages
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL PENSIONFORGE, LLC, ITS OFFICERS, DIRECTORS, MEMBERS, EMPLOYEES, AGENTS, OR AFFILIATES BE LIABLE FOR ANY:
- INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES;
- LOSS OF PROFITS, REVENUE, DATA, OR BUSINESS OPPORTUNITIES;
- COST OF SUBSTITUTE SERVICES;
- DAMAGES ARISING FROM YOUR RELIANCE ON ANY PROJECTION, CALCULATION, OR OUTPUT OF THE SERVICE;
- DAMAGES ARISING FROM FINANCIAL DECISIONS MADE BASED ON INFORMATION PROVIDED BY THE SERVICE;
WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
11.2 Cap on Liability
TO THE EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY TO YOU FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SERVICE SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100.00).
11.3 Essential Basis of Bargain
THE LIMITATIONS IN THIS SECTION REFLECT THE ALLOCATION OF RISK BETWEEN THE PARTIES AND ARE AN ESSENTIAL BASIS OF THE BARGAIN BETWEEN US. THE SERVICE WOULD NOT BE PROVIDED WITHOUT THESE LIMITATIONS.
12. Indemnification
You agree to indemnify, defend, and hold harmless PensionForge, LLC and its officers, directors, members, employees, agents, and affiliates from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable attorneys' fees) arising out of or in connection with:
- Your use of the Service;
- Your violation of these Terms;
- Your violation of any applicable law or regulation;
- Financial decisions you make based on outputs from the Service;
- Your negligence or willful misconduct;
- Any claim by a third party arising from your use of the Service or data you entered on behalf of a third party.
13. Dispute Resolution
13.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.
13.2 Informal Resolution
Before initiating any formal dispute resolution, you agree to first contact us at team@pensionforge.com and attempt to resolve the dispute informally for a period of at least thirty (30) days.
13.3 Binding Arbitration
If informal resolution is unsuccessful, any dispute, controversy, or claim arising out of or relating to these Terms or your use of the Service shall be resolved by binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules. The arbitration shall be conducted in the State of Florida. The arbitrator's decision shall be final and binding.
13.4 Class Action Waiver
YOU AND PENSIONFORGE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND MAY NOT OTHERWISE PRESIDE OVER ANY FORM OF A REPRESENTATIVE OR CLASS PROCEEDING.
13.5 Exceptions
Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights or to prevent irreparable harm.
13.6 Small Claims Exception
Either party may bring an individual action in small claims court if the claim falls within that court's jurisdictional limits.
14. Service Availability and Modifications
14.1 Availability
We strive to maintain high availability of the Service but do not guarantee uninterrupted access. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
14.2 Modifications
We reserve the right to modify, suspend, or discontinue any aspect of the Service at any time, with or without notice. We will endeavor to provide reasonable advance notice of material changes that affect paid subscribers.
14.3 Calculation Engine Updates
We periodically update the Service's calculation engine to reflect changes in FRS rules, tax law, and actuarial factors. Updated calculations apply prospectively; previously generated reports reflect the rules in effect at the time of generation.
15. Email Communications
15.1 Transactional Emails
By creating an account, you consent to receive transactional emails necessary for the operation of the Service, including authentication links, account notifications, and subscription receipts.
15.2 Alert Notifications
If you configure threshold alerts, you consent to receive email notifications when your defined thresholds are triggered. You may disable individual alerts or unsubscribe from alert emails at any time via the unsubscribe link included in each notification or through your account settings.
15.3 Waitlist Communications
If you join a waitlist, you consent to receive a confirmation email and subsequent notification when the waitlisted feature or tier becomes available. You may unsubscribe from waitlist communications at any time.
15.4 Service Announcements
We may occasionally send emails regarding material changes to the Service, security notices, or policy updates. These communications are not marketing and cannot be individually opted out of while maintaining an active account.
16. Children and Minors
16.1 Age Requirement
The Service is intended for users aged eighteen (18) and older. We do not knowingly collect personal information from individuals under 18.
16.2 Household Data Involving Minors
The household modeling feature is designed for modeling spousal or partner retirement income. You may not enter the personal information of a minor (under 18) into the Service unless (a) you are the minor's parent or legal guardian, and (b) the information is limited to what is reasonably necessary for dependent-related retirement calculations (e.g., dependent care projections).
16.3 Discovery of Minor Data
If we discover that we have collected personal information from a person under 18 without appropriate authorization, we will promptly delete that data and, if applicable, terminate the associated account.
17. Miscellaneous
17.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and PensionForge, LLC regarding the Service and supersede all prior or contemporaneous agreements, representations, or understandings.
17.2 Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.
17.3 Waiver
Our failure to enforce any right or provision of these Terms shall not constitute a waiver of such right or provision. Any waiver must be in writing and signed by us.
17.4 Assignment
You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction.
17.5 Force Majeure
We shall not be liable for any failure or delay in performance resulting from causes beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemics, government actions, internet or utility failures, or third-party service outages.
17.6 No Third-Party Beneficiaries
These Terms do not create any third-party beneficiary rights.

19. Special Notices
19.1 Florida Residents
If you are a Florida resident, you may have additional rights under the Florida Deceptive and Unfair Trade Practices Act (FDUTPA). Nothing in these Terms is intended to limit any rights you may have under applicable Florida consumer protection laws that cannot be waived by contract.
19.2 California Residents
If you are a California resident, you may have additional rights under the California Consumer Privacy Act (CCPA) and the California Privacy Rights Act (CPRA). Whether PensionForge is a "business" under the CCPA depends on applicable revenue and data-processing thresholds. Regardless of threshold applicability, we honor the data rights described in our Privacy Policy. If PensionForge meets CCPA thresholds at any point, we will publish a conforming California Privacy Notice.
Additionally, California Business and Professions Code sections 17600-17606 impose requirements on automatic-renewal offers. Our compliance is described in Section 5.8.
